The Operator acknowledges and understands that operating a motorized vehicle, such as an E-Tech Kart, carries inherent risks, including but not limited to the risk of bodily injury, property damage, and loss. The Operator voluntarily assumes all risks associated with the operation of the E-Tech Kart.

2. Release of Liability:

The Operator hereby releases, waives, and discharges the Company, its officers, directors, employees, affiliates, agents, and representatives from any and all liability, claims, demands, actions, and causes of action arising out of or related to the operation, maintenance, or use of the E-Tech Kart, including but not limited to:

  • Personal injury
  • Property damage
  • Loss or theft of personal belongings
  • Accidents or collisions
  • Mechanical failures or malfunctions
  • Negligence or misconduct of other Operators or third parties

3. Indemnification:

The Operator agrees to indemnify, defend, and hold harmless the Company, its officers, directors, employees, affiliates, agents, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses, including legal fees and expenses, arising out of or related to:

  • The Operator's use or misuse of the E-Tech Kart
  • Violation of any laws, regulations, or ordinances
  • Breach of any terms or conditions outlined in this liability disclaimer
  • Any third-party claims arising from the Operator's actions or omissions

4. Operator Responsibility:

The Operator is solely responsible for:

  • Ensuring that the E-Tech Kart is operated in a safe and lawful manner at all times.
  • Complying with all applicable laws, regulations, and ordinances governing the operation of motorized vehicles.
  • Performing regular maintenance and inspections of the E-Tech Kart to ensure its safe operation.
